Terms of Service

1. Agreement

These Terms of Service ("Terms") are a contract between you and Housingstreet Marketing and Consulting Private Limited, a company incorporated in India (CIN U67100DL2020PTC367725), with its registered office at H. No. B-165, Ambedkar Colony, Gali No. 1, Chattarpur, South Delhi, New Delhi – 110074, India.

By creating an account, starting a trial, or using HousingStreet (the "Service"), you agree to these Terms and our Privacy Policy. If you accept on behalf of a company or agency, you represent that you have authority to bind that organization.

2. The Service

HousingStreet is subscription software delivered over the internet. It helps real estate professionals manage listings, client pipelines, websites, content, team permissions, and related workflows. Features vary by plan; we describe current capabilities on our pricing and features pages.

We may improve, change, or discontinue features with reasonable notice for material reductions. Beta or early-access features may be offered "as is" and can change without notice.

3. Accounts and eligibility

• You must be at least 18 years old and legally able to enter contracts
• Registration information must be accurate and kept up to date
• You are responsible for credentials and all activity under your account
• Notify us immediately at security@housingstreet.com if you suspect unauthorized access
• One person may not share login credentials across unrelated businesses unless your plan explicitly allows it

4. Acceptable use

You may use HousingStreet only for lawful real-estate and related business purposes. You agree not to:

• Post false, misleading, or discriminatory property listings or advertising
• Upload content that infringes intellectual property or privacy rights
• Harass, spam, or phish leads, clients, or other users
• Attempt to bypass security, probe systems, or scrape data you are not authorized to access
• Use the Service for illegal activities, money laundering, or sanctioned parties
• Resell or white-label the platform except as expressly permitted on an Enterprise agreement
• Overload or interfere with infrastructure (including automated abuse)

We may suspend or terminate accounts that violate these rules or pose risk to other customers or payment partners.

5. Your content

You retain ownership of listings, photos, lead data, and other materials you upload ("Customer Content"). You grant us a limited license to host, process, display, and back up Customer Content solely to provide and improve the Service.

You are responsible for having the right to use and publish Customer Content — including property photos, client contact details, and website copy — and for complying with local real-estate advertising and data-protection laws.

6. Subscriptions, trials, and payments

Paid plans are billed in advance on a monthly or annual cycle through Stripe (or another processor we designate). Prices are shown at checkout in the currency displayed on our pricing page and may exclude applicable taxes unless stated otherwise.

Free trial

We may offer a 7-day free trial without requiring a payment method, or with a card on file depending on the signup flow shown at the time. When a trial ends, continued access requires an active paid subscription unless we agree otherwise in writing.

Auto-renewal

Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel from billing settings in platform-admin or by emailing hello@housingstreet.com. Cancellation stops future charges; access continues until the end of the current paid period.

Refunds

Fees are generally non-refundable except where required by law or where we explicitly state otherwise on the pricing page or in writing. If you believe you were charged in error, contact us within 14 days of the charge with your invoice number.

Taxes

You are responsible for applicable taxes (including GST/VAT) unless we are required to collect and remit them. Invoices are issued in the name of Housingstreet Marketing and Consulting Pvt. Ltd..

Failed payments

If payment fails, we may retry, restrict features, or suspend the workspace after notice. Long-term non-payment may result in account closure and deletion of data after a retention window described in our Privacy Policy.

7. Our intellectual property

HousingStreet, our logos, software, documentation, and theme system are owned by Housingstreet Marketing and Consulting Private Limited or our licensors. These Terms do not grant you any rights to our trademarks except as needed to use the Service in the ordinary course.

8. Third-party services

The Service may integrate with third parties (payment processors, domain registrars, communication providers, analytics). Their terms apply to those services. We are not responsible for third-party outages or policies outside our control.

9. Availability and support

We target high availability but do not guarantee uninterrupted access. Planned maintenance will be communicated when practical. Support channels and response targets depend on your plan as described on our website.

10. Suspension and termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate access for breach of these Terms, non-payment, legal requirement, or risk to the platform. Upon termination, your license ends; export your data before closure where tools are available.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. HOUSINGSTREET DOES NOT GUARANTEE REAL-ESTATE TRANSACTIONS, LEAD VOLUME, OR REGULATORY COMPLIANCE OF YOUR LISTINGS — YOU REMAIN RESPONSIBLE FOR YOUR BUSINESS AND LOCAL LAWS.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER HOUSINGSTREET MARKETING AND CONSULTING PRIVATE LIMITED NOR ITS DIRECTORS, EMPLOYEES, OR AGENTS SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100 IF YOU HAVE NOT PAID FEES.

13. Indemnification

You will defend and indemnify Housingstreet Marketing and Consulting Pvt. Ltd. against claims arising from your Customer Content, your use of the Service in violation of law or these Terms, or disputes with your clients or leads.

14. Governing law and disputes

These Terms are governed by the laws of India. Courts in New Delhi, India shall have exclusive jurisdiction, subject to mandatory consumer protections in your country of residence where they cannot be waived.

Before filing suit, please contact legal@housingstreet.com so we can try to resolve the dispute informally within 30 days.

15. Changes

We may update these Terms. We will post the revised version with a new "Last updated" date. Material changes to paid customers will be notified by email or in-app notice when practicable. Continued use after the effective date constitutes acceptance.
